Man Tries to Hang Himself After DUI Arrest
Posted By Phoenix DUI Lawyer

Police are saying that a man from Apache Junction tried to kill himself in the back of a police vehicle by wrapping a seat belt around his neck. On Thursday night, the man was arrested for suspicion of drunk driving said Mesa officers.

Police report that they received a call about a drugged driver in a black Corvette who allegedly ran a red light and was driving into oncoming traffic near Southern Avenue.  Officers later found the car on the 900 block of South 97th Way.

According to police, when they pulled over 33-year-old Keith Thompson he had watery eyes and the scent of alcohol on his breath.  Thompson told police he had consumed alcohol and should not have been driving. When police asked him to take this a variety test he admitted that he was impaired by alcohol and was operating on a suspended license.

After Thompson was arrested, officers were forced to restrain him because he attempted to hang himself several times in the back of the police car with a seatbelt that he had wrapped around his neck.

He was later taken to Arizona Regional Medical Center at his request and booked on driving under the influence charges.

Scottsdale Home Detention Program for DUI Convicts to take Effect in October
Posted By Phoenix DUI Lawyer

News sources report that those who have been convicted of driving under the influence in Scottsdale, Arizona will not have the option of serving their sentence under house arrest until October of 2010.  At this time, Scottsdale City Court officials are working with city officials to find an electronic monitoring vendor for the program.

In April, the Scottsdale City Council approved the house arrest program for convicted DUI offenders as court officials said it may be a way for the city to cut costs.  In the state of Arizona, cities have been allowed to have home-detention programs for years and municipal courts have taken advantage of such programs.

Once the program goes into effect, people who are convicted of DUI will have to serve time in Maricopa County Jail.  This costs $172 the first day and $72 each subsequent day.  After 15 days have passed, convicted DUI offenders would be allowed to serve the remainder of their jail time at home.  The price for a home detention costs approximately $100 to set up and then $10 to $18 for subsequent days, which is quite a savings compared to jail time.

It is important to note that not all DUI offenders will be eligible for house arrest.  People who are ineligible are violent offenders and domestic violence offenders.

  DUI and Field Sobriety Tests
Posted By Phoenix DUI Lawyer

After people have been pulled over for suspicion of driving under the influence (DUI) in Phoenix, a few things will happen.  First, officers will look for signs of impairment, such as blood shot eyes or slurred speech.  If officers notice signs of impairment, they will usually ask drivers to take a breath test.  They will also ask drivers to perform field sobriety tests.

Decades ago, the National Highway Traffic and Safety Administration came up with a series of agility tests that were meant to show whether or not people were impaired by drugs and/or alcohol.  Today, most law enforcement officers administer three field sobriety tests:  the one-leg stand, the horizontal gaze nystagmus and the walk and turn.

When people are performing these tests, officers watch for signs that may be indicative of impairment such as people failing to follow instructions, people wobbling or people having overall difficult completing tests.  If officers believe people have failed the FSTs, they may choose to make DUI arrests.

Were you arrested for DUI in Phoenix because you failed your field sobriety tests?  If you said "yes", contact the Knowles Law Firm to discuss your case with a Phoenix DUI lawyer.

Arizona Supreme Court Makes Blood Test Ruling
Posted By Phoenix DUI Lawyer

This week, the Arizona Supreme Court made a final ruling regarding blood tests and DUI cases.  The Court ruled that police must have a search warrant in order to require a blood test during a driving under the influence arrest.  The only exception to this ruling is when drivers give police consent.

For weeks, the decision had been much anticipated.  The Arizona Supreme Court needed to make a ruling after several prosecutors used the implied-consent statute to get blood samples from people who were arrested for DUI throughout the state.  Reports indicate that in these cases, if suspects did not refuse testing, they were told to give a blood sample.

In the future, law enforcement officers must inform all DUI suspects of their right to refuse blood testing and must also explain the consequences of refusing testing, which include mandatory license suspension.  If suspects are provided with a warrant, they must submit to blood tests.

  Signs of Drunk Driving
Posted By Phoenix DUI Lawyer

There are several indicators police look for when determining whether or not to pull someone over on suspicion of drunk driving. These suspicious driving patterns include:

  • Straddling two lanes
  • Driving extremely slowly
  • Making abnormally large turns
  • Braking erratically
  • Constantly speeding up or slowing down
  • Not being able to drive in a straight line
  • Running a red light or rolling through a stop sign
  • Drifting
  • Almost hitting another car or almost striking a stationary object

Once an officer has noticed at least one or two of these driving patterns, there is reasonable cause to believe the driver could be intoxicated, and therefore the officer has the right to pull the driver over to further investigate the situation. As the officer approaches the driver, there are several more signs the officer will look for to determine if the driver is intoxicated. These are physical signs, and include:

  • The smell of alcohol on the breath
  • Flushed cheeks
  • Glassy or bloodshot eyes
  • Slurred speech
  • Inability to walk straight
  • Difficultly following instructions or answering questions
  • Disheveled appearance

If the officer notices any of these signs, there is a good chance he'll arrest the driver for DUI right then and there. He may ask the driver to submit to a field sobriety test or breath or blood test, but at that point the officer has usually made his or her decision to arrest the driver.

Driver Faces DUI & Other Charges Following Accident

What could have been a typical DUI arrest quickly escalated when the suspect, believed to be intoxicated, assaulted two Department of Public Safety officers.

The incident occurred at the scene of a pickup truck accident on Interstate 10. The suspect became uncooperative at the scene and began assaulting the officer. When the officer’s partner arrived at the scene, she assaulted him as well.

The officers were able to arrest the suspect and bring her into custody. In addition to DUI charges, she also faces two counts of aggravated assault on a police officer and one count of resisting arrest.   Phoenix Police Officer Faces Drunk Driving Charges
Posted By Phoenix DUI Lawyer

A Phoenix police officer has been charged with DUI and failure to obey an officer following a incident that took place January 3.

At about 10:30 a.m. on January 3, a Gilbert police officer found Seth Samuel Castillo of the Phoenix Police Department slumped over the passenger seat, unconscious behind the wheel of this jeep. The Gilbert officer made several attempts to rouse Castillo but to no avail. Once Castillo woke up, the officer ordered him to step out of the car and place his hands on the hood of the vehicle.

In his report the officer said Castillo made a motion like he was reaching for something around his wasit, instead of putting them on the vehicle. Fearing that Castillo was reaching for a weapon and unaware that he was a police officer, the officer tasered Castillo. It wasn’t until Castillo had fallen to the ground that he told the officer he was an off-duty Phoenix police officer.

Castillo eventually admitted that he had consumed two 24-ounce beers and took Ritalin, a prescription drug. Lab results indicated Castillo’s blood alcohol concentration at the time of the incident was .172, more than twice the legal limit.

Despite his charges—one for DUI and one for failure to obey an officer—Castillo is still on active duty while both the criminal and internal investigations are underway.

Country Radio DJ Arrested for DUI
Posted By Phoenix DUI Lawyer

A popular Scottsdale radio DJ was recently arrested for driving under the influence, according to an article on azcentral.com.

George B. Campbell, who makes up half the Ben & Matt morning show on KNIX county radio station 102.5, was arrested January 8 on suspicion of DUI.

Police allegedly clocked Campbell driving close to 90 mph in a 50-mph zone. A police report also indicated that Campbell submitted to a breathalyzer test and blew a .144. If Campbell’s BAC test had registered at .15% he could have been charged with Extreme DUI.

Campbell told the officers that he was heading home from a college football game and had had “a few beers on the plane." He apologized for speeding and asked the officers if they would just take him home. The officers refused Campbell’s request and brought him into custody, where he was booked into jail.  He was later released.

DUI Checkpoint Warnings Sent Through Twitter
Posted By Phoenix DUI Lawyer

When DUI checkpoints first started, it was a way for law enforcement officials to catch unsuspecting drunk drivers.  Part of the reason these checkpoints were so effective, and have continued to be effective, is that they catch drunk drivers off-guard.  Once a driver pulls into a checkpoint there is no way of getting around it.  The only way to pass through a checkpoint is to actually go through it.

Newspapers, TV news anchors, and other news outlets sometimes report when a DUI checkpoint is scheduled, but now people are taking matters into their own hands. Users of Twitter, the popular social networking/micro blogging site, are sending tweets altering people to the whereabouts of DUI checkpoints. When a person posts a tweet, it reaches his/her “Twitter friends” instantaneously, and many people have twitter updates sent directly to their cell phones in the form of a text message. Should a tweet come through about a DUI checkpoint, people can easily drive in the other direction if they’ve had too much to drink.

It seems as though police aren’t really angry about the warnings, but rather are concerned that drunk drivers who should be caught and arrested are still on the road,  risking the lives and safety of those around them.  Police officers are also concerned about people looking at their cell phones while driving, which has proven to increase a person’s chances of getting involved in an accident.

Prescott Man Faces Multiple DUI Charges after Attempted Trespassing
Posted By Phoenix DUI Lawyer

A Prescott man faces multiple charges after trespassing on a woman’s property and then driving away drunk.

According to the Prescott Valley Police, the man, later identified as 43-year-old Richard Cole, appeared at the woman’s sliding glass door early Tuesday morning, and then went around to the front of the house to ring the door bell.

Cole then took off in a gray four-door car, which officers were eventually able to locate and pull over.

Upon observation, officers believed Cole to be driving under the influence of alcohol, and a DUI investigation revealed Cole's blood alcohol concentration was above the legal limit.  He was also driving without an ignition interlock device.

Cole was taken into police custody and booked into the Yavapai County Jail on the following charges: aggravated DUI, extreme DUI, DUI over .08 percent, DUI impairment, failure to have an ignition interlock device, and trespassing.

Needless to say, if convicted Cole can expect harsh sentencing from the judge, which is likely to include imprisonment, large fines, probation, mandatory alcohol classes, and the suspension or revocation of his driver’s license.
