Woman Arrested for DUI Hours before her Wedding
Posted By Phoenix DUI Lawyer

This week Saturday, a 31-year-old woman from Bellevue was arrested for suspicion of driving under the influence. Ironically, her arrest occurred just hours before she was supposed to walk down the aisle said the Washington State patrol.

Police stopped the woman just after 6 AM when a deputy spotted her weaving in and out of her lane and speeding at more than 90 mph on northbound Interstate 405 near Northeast Eighth Street.  When pulled over, the woman told the deputy that she was driving home from her bachelorette party and was getting married that afternoon.

She admitted that she had been arrested for driving under the influence once before and was familiar with the DUI traffic stop routine.  Police took her blood alcohol level which was measured in at .146, twice the legal limit in the state of Washington.

The officer presiding over the case said the woman will face charges in King County District Court.

Arizona Supreme Court Makes Blood Test Ruling
Posted By Phoenix DUI Lawyer

This week, the Arizona Supreme Court made a final ruling regarding blood tests and DUI cases.  The Court ruled that police must have a search warrant in order to require a blood test during a driving under the influence arrest.  The only exception to this ruling is when drivers give police consent.

For weeks, the decision had been much anticipated.  The Arizona Supreme Court needed to make a ruling after several prosecutors used the implied-consent statute to get blood samples from people who were arrested for DUI throughout the state.  Reports indicate that in these cases, if suspects did not refuse testing, they were told to give a blood sample.

In the future, law enforcement officers must inform all DUI suspects of their right to refuse blood testing and must also explain the consequences of refusing testing, which include mandatory license suspension.  If suspects are provided with a warrant, they must submit to blood tests.

31 Year Old Charged with DUI and Assault
Posted By Phoenix DUI Lawyer

In Phoenix, a 31 year old man is now facing charged if DUI and aggravated assault.  Police say that while driving drunk, the man crashed his car into a canal.

The canal was located near 67th Avenue and Buckeye Road.  Police report that the vehicle was seriously damaged and that the accident took place last Friday at around 7:00 PM.  The officer that arrived at the scene of the accident said that three people were inside the car, but after the accident, they fled the scene.  They were later picked up by a person driving a white SUV.

Witnesses that saw the accident gave police a description of the white SUV, which was tracked down a short time later.  When police found the driver of the SUV, he told them where he took the three individuals.  Police went to the address and found all three at the residence with minor injuries. They were all escorted to a local hospital for treatment.

The driver of the car had a cut on his head and also had a BAC of 0.146%, which is well above the state's legal blood alcohol limit.  Aside from being charged with DUI, the driver is also facing charges for leaving the scene of an accident as well as endangerment.

Arizona Supreme Court Considers DUI Blood Test Ruling
Posted By Phoenix DUI Lawyer

Police and sheriff’s deputies may have new protocol to follow when a driver is pulled over on suspicion of DUI.

The Arizona Supreme Court will consider whether law enforcement authorities must obtain a search warrant in order to conduct a blood test of a DUI suspect if the suspect doesn’t give clear consent to have his or her blood withdrawn.

A Court of Appeals ruling found that it wasn’t enough under state law that a man didn’t object when officers moved to take a blood sample while in a police DUI van. The appeals court said the law in question is called the “implied consent” law because drivers must consent to have their blood drawn or they will be subjected to a civil driver’s license suspension for a refusal. The appeals court did say in their ruling that drivers do have the right to withhold consent for a “non-warrant search.”
