Under state law you can be arrested for a DUI even if you have had just one drink, and even if you are not legally intoxicated. While in most states you are arrested for a DUI based on your blood-alcohol content; in Arizona, there are two laws that allow officers to charge you even if your BAC does not exceed 0.08. If you are seen driving erratically or if you had been driving a car two hours prior to being discovered with a BAC that exceeds the state limit, you can be arrested for a DUI.
